Additional Terms of Use

Effective November 3, 2026 · Also in Français · Español. If the versions differ, the English version applies, except where the law of your province or state requires otherwise.

Your use of the Momentide app ("the App") is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"). These additional terms ("Terms") are between you and the developer of the App ("we", "us") and add to the Standard EULA; they do not replace it. If these Terms and the Standard EULA conflict, the Standard EULA applies. By using the App you also agree to these Terms. If you do not agree, please do not use the App. Our Privacy Policy explains how we handle your data.

1. Your account

You need an account to use the App. You must be at least 13 years old (14 in Canada). If you are under the age of majority where you live, please use the App with the permission of a parent or guardian. Keep your sign-in details safe; you are responsible for activity under your account. You can delete your account at any time in Profile → Delete account.

2. Momentide Pro subscriptions

• Some features require a paid Momentide Pro subscription, offered with weekly, monthly or yearly billing. The price, length and content of each plan are shown in the App before you buy.
• Payment is charged to your Apple Account when you confirm the purchase.
• The subscription renews automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel the subscription in your Apple Account settings (iPhone Settings → your name → Subscriptions). Cancelling stops the next renewal; you keep Pro until the end of the period you paid for.
• If a free trial is offered, any unused part of it ends when you buy a subscription.
• Purchases are processed by Apple. Refunds are handled by Apple under its policies at reportaproblem.apple.com; we cannot issue refunds for App Store purchases. Nothing in these Terms limits a right of withdrawal or refund you have under the law of your country.
• If we change subscription prices, Apple will notify you and, where required, ask for your consent before the new price applies.
• Deleting your account does not cancel your subscription. Please cancel it in your Apple Account settings.

3. Not medical advice

Momentide is made for relaxation, focus and reflection. It is not a medical device, does not provide medical, psychological or therapeutic advice, and does not diagnose, treat or prevent any condition. Sounds, mantras and AI-written text are not a substitute for professional care. Do not use sound sessions while driving or operating machinery. Binaural sounds are designed for headphones; keep the volume at a comfortable level.

4. AI-written content

With your consent, some text in the App is written by an AI model (Claude by Anthropic). When you use these features you are interacting with an AI, not a person, and the App marks AI-written text. AI output can be inaccurate, generic or unsuitable, so use your own judgement. We filter requests and replies but cannot guarantee every reply. You can turn AI features off at any time in the App.

5. Your content

You own what you write and record in the App ("Your Content"). You give us a limited license to store, process and display Your Content only to provide the App to you, including sending text to our service providers as described in the Privacy Policy. We do not use Your Content for advertising or to train AI models. When you share a ritual recipe, the recipe travels inside the link; anyone with the link can open it, so share only what you are happy for others to see.

6. Acceptable use

Do not use the App to break the law; to upload content that infringes others' rights; to try to access other users' data or our systems without permission; to overload, probe or disrupt the service; or to get around usage limits or Pro features. We may suspend or end access for serious or repeated misuse.

7. Our content

The App, its design, sounds, texts (other than Your Content) and the Momentide name and logo belong to us or our licensors and are protected by law. These Terms do not give you any rights to them other than the right to use the App under the Standard EULA.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for the App and subscriptions in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer. Some states and provinces, including Quebec, do not allow some of these exclusions or limits, so they may not apply to you.

9. Ending these Terms

You can stop using the App and delete your account at any time. We may end or suspend your access if you seriously breach these Terms, or if we stop offering the App; if we stop offering it, we will tell you in advance where reasonably possible. Sections 3, 5, 7 and 8 to 11 continue to apply after these Terms end.

10. Changes

We may update these Terms, for example when we add features or when the law changes. We will update the date above and, for significant changes, tell you in the App before they apply. If you keep using the App after that, the new Terms apply.

11. Governing law

These additional Terms are governed by the laws of Türkiye, without regard to its conflict of law rules. If you are a consumer, you also keep the protection of the mandatory laws of the state, province or country where you live, and you may bring claims in its courts. Nothing in these Terms requires you to use arbitration or waives your right to take part in a class action where the law gives you that right. The Standard EULA is governed by the law it names.
